When Federal and State Laws Clash over Insurance Proceeds. Description: Who is entitled to life insurance proceeds when the decedent failed to change the beneficiary after a divorce, and dies with the ex-spouse still the named beneficiary? In this one hour presentation, Attorney David Kennedy will explore Ohio’s common law history, review the particulars of Ohio’s “re-designation statute” (Rev. Code §5815.33), conduct a case study of a case he successfully litigated in Summit County Probate Court, and examine how and when Federal law may pre-empt Ohio statutes, divorce decrees, or domestic court orders. The presentation will conclude with some helpful litigation strategies and planning tips for your divorced clients.
